1. USER INFORMATION

LabGenetics S.L (Laboratorio de Genética Clínica S.L), hereinafter referred to as RESPONSIBLE, is the Data Controller of the User’s personal data and informs the User that this data will be processed in accordance with the provisions of current data protection regulations, the Regulation (EU) 2016/679 of April 27, 2016 (GDPR) related to the protection of individuals regarding the processing of personal data and the free movement of such data, and the Organic Law (ES) 15/1999 of December 13 (LOPD) related to the protection of personal data. Therefore, the following information on data processing is provided:

Purpose of the processing: to maintain a commercial relationship with the User. The operations planned for processing are:

  • Sending advertising communications via email, fax, SMS, MMS, social communities, or any other electronic or physical medium, present or future, that allows for commercial communications. These communications will be made by the RESPONSIBLE and related to its products and services, or those of its collaborators or suppliers with whom it has reached a promotional agreement. In this case, third parties will never have access to personal data.
  • Conducting statistical studies.
  • Processing orders, requests, or any type of request made by the user through any of the contact forms provided.
  • Sending the website’s newsletter.

Data retention criteria: Data will be retained as long as there is a mutual interest in maintaining the purpose of processing and when it is no longer necessary for such purpose, it will be deleted with appropriate security measures to ensure the pseudonymization or total destruction of the data.

Data communication: Data will not be communicated to third parties, except when required by law.

Rights of the User:

  • Right to withdraw consent at any time.
  • Right of access, rectification, portability, and deletion of their data and to restrict or object to its processing.
  • Right to file a complaint with the supervisory authority (agpd.es) if they believe that the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

Users, by checking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or presented in download forms, expressly and unequivocally agree that their data is necessary to address their request by the provider, with the inclusion of data in the remaining fields being voluntary. The User guarantees that the personal data provided to the RESPONSIBLE is accurate and is responsible for communicating any changes to such data.
The RESPONSIBLE expressly informs and guarantees users that their personal data will not be transferred to third parties in any case, and that whenever any transfer of personal data is made, the express, informed, and unequivocal consent of the Users will be requested. All data requested through the website is mandatory, as it is necessary for providing optimal service to the User. If all data is not provided, it cannot be guaranteed that the information and services provided will fully meet their needs.

3. SECURITY MEASURES

In accordance with current data protection regulations, the RESPONSIBLE is complying with all provisions of GDPR and LOPD regulations for the processing of personal data under its responsibility, and expressly with the principles described in Article 5 of GDPR and Article 4 of LOPD, whereby data is processed lawfully, fairly, and transparently in relation to the data subject and is adequate, relevant, and limited to what is necessary in relation to the purposes for which it is processed.

The RESPONSIBLE guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by GDPR and LOPD in order to protect the rights and freedoms of Users and has provided them with the necessary information to exercise those rights.
